• support nervous system regulation and presence
• encourage gentle reflection and self-awareness

magicwork is not:

• a medical, psychological, psychiatric, or therapeutic service
• a crisis support or emergency service
• a provider of professional advice (medical, legal, financial, or otherwise)

The Service is intended for self-reflection and wellbeing support only.

If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, contact local emergency services or a crisis hotline immediately.

3. Eligibility

To use the Service, you must:

• be at least 18 years old, or use the Service only with the involvement and consent of a legal guardian where permitted by law; and
• be legally able to enter into a binding contract.

By using the Service, you confirm that you meet these requirements.

• We do not guarantee any specific outcome or benefit from using the Service

• misrepresent AI-generated Output as professional or human-authored advice

We may suspend or terminate access if these rules are violated.

9. No Medical or Crisis Use

You agree not to use the Service:

• for emergencies or crisis situations
• as a substitute for therapy, counseling, or medical treatment
• to seek urgent medical or psychiatric care

magicwork is not a healthcare provider.

10. Intellectual Property

Except for your Input, all elements of the Service are owned by magicwork or its licensors, including:

• branding, name, and logo
• design, text, audio, and visuals
• software, models, and code

You may not copy, distribute, or create derivative works without permission.

You may share personal experiences, screenshots, or clips for non-commercial purposes, provided you do not misrepresent Output as professional advice.

11. Paid Features and Subscriptions (If Applicable)

If paid features are offered:

• pricing will be shown clearly
• subscriptions may renew automatically unless canceled
• refunds follow the platform's policies (e.g., Apple App Store, Google Play) and applicable law

The Service is provided "as is" and "as available".

To the fullest extent permitted by law, we disclaim all warranties, including:

• uninterrupted or error-free operation
• accuracy or suitability of Output
• any guaranteed benefit or outcome

Use of the Service is at your own discretion and risk.

To the fullest extent permitted by law:

• magicwork is not liable for indirect, incidental, or consequential damages
• total liability is limited to the greater of: the amount you paid in the 6 months before the claim, or $100 USD

Nothing limits liability where prohibited by law.

14. Indemnification

You agree to indemnify and hold harmless magicwork LLC from claims arising from:

• your misuse of the Service
• your violation of these Terms
• your violation of third-party rights

15. Changes to the Service and Terms

We may modify or discontinue features and update these Terms.

When material changes occur, we will update the date above and, where appropriate, notify you.

Continued use constitutes acceptance.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

Nothing in these Terms affects your rights under applicable consumer protection laws.

You may stop using the Service at any time.

We may suspend or terminate access if:

• you violate these Terms
• required by law or platform providers
• we discontinue the Service

Sections that should survive termination will continue to apply.

You agree not to use the Service in violation of applicable export control or sanctions laws.
